01 Agreement to these terms
By downloading, installing, or using Sleep Stats (the "App"), you agree to these Terms of Service (the "Terms"). If you do not agree, please do not use the App. If you use the App on behalf of someone else, you confirm you're authorized to accept these Terms for them.
02 Your license to use the app
Subject to these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable, revocable license to install and use the App on Apple devices that you own or control, as permitted by the App Store Terms of Service. This license is for your own personal, non‑commercial use.
03 Acceptable use
You agree not to:
- copy, modify, distribute, sell, or lease any part of the App;
- reverse engineer, decompile, or attempt to extract the source code, except where this restriction is prohibited by law;
- use the App to build a competing product, or to violate any applicable law or third‑party right;
- interfere with or disrupt the integrity or performance of the App.
04 Health disclaimer
The scores, stages, recovery, strain, body‑battery, and bedtime suggestions the App provides are estimates derived from sensor data and should not be relied upon for medical decisions. They can be inaccurate or incomplete. Always seek the advice of a qualified physician or health provider with any questions about a medical condition or before making changes to your sleep, exercise, or health routine. Never disregard professional medical advice or delay seeking it because of something you read in the App. If you think you may have a medical emergency, call your doctor or emergency services immediately.
05 HealthKit & your data
The App reads data from Apple HealthKit only with your permission and uses it solely to provide the App's features on your device, as described in our Privacy Policy. We will not use HealthKit data for advertising or share it with third parties for marketing. You can revoke access at any time in iOS Settings. You are responsible for keeping your device and your Apple account secure.
06 Subscriptions & billing
The App is free to download and includes optional Premium features available through an in‑app purchase or auto‑renewing subscription sold by Apple.
- Payment & renewal. Payment is charged to your Apple Account. Subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period.
- Managing & cancelling. You can manage or cancel anytime in Settings → your name → Subscriptions. Cancellation stops future renewals; it doesn't retroactively refund the current period.
- Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Refunds. Purchases are processed by Apple and governed by Apple's terms; refund requests are handled by Apple.
- Price changes. If we change subscription pricing, we'll notify you and obtain consent where required before the change applies to you.
07 Intellectual property
The App, including its design, text, graphics, the "Sleep Stats" name, logo, and all related intellectual property, is owned by Sleep Stats and protected by law. These Terms don't grant you any rights to our trademarks or branding. The data the App computes from your Health data is yours.
08 Apple & the App Store
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content. To the extent the App is a "Licensed Application" under Apple's standard end‑user license agreement, that agreement also applies, and where there is a conflict on Apple‑specific points, Apple's terms control for those points. You agree that Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them. You also confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted‑parties list.
09 Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non‑infringement. We do not warrant that the App will be uninterrupted, error‑free, or that its readings will be accurate or reliable. You use the App at your own discretion and risk.
10 Limitation of liability
To the maximum extent permitted by law, Sleep Stats and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the App. To the extent liability cannot be excluded, our total liability for any claim is limited to the greater of the amount you paid for the App in the 12 months before the claim, or USD $50. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
11 Termination
You may stop using the App at any time by deleting it. We may suspend or end your license if you materially breach these Terms or if we discontinue the App. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and governing law — will survive termination.
12 Governing law
These Terms are governed by the laws of the State of Mississippi, United States, without regard to its conflict‑of‑laws rules. You agree that the courts located in Mississippi will have exclusive jurisdiction over any dispute, unless mandatory local consumer law gives you the right to bring a claim where you live.
13 Changes to these terms
We may update these Terms as the App evolves. When we do, we'll revise the "Last updated" date above and, for material changes, give reasonable notice in the App or on this site. Continuing to use the App after changes take effect means you accept the updated Terms.
